  1. How does the ability to conduct legal searches differ between the police officer, probation officer, and prison guard in the performance of their duties? Give an example of interagency collaboration when conducting a legal search.

In order for the criminal justice system to work it has to be organized. Everyone must collaborate and be on the same page. Even though different officers have different titles, they must all agree on certain terms. Legal searches for a police officer works quite differently than that of a prison guard or a probation officer. In order for any legal searches to be executed, the police must obey the law of the stop and frisk. This law is present in a situation in which the police officer that is suspicious of an individual detains this person and searches with his hands in the suspect’s body for a weapon or illegalities. If the cop finds something illegal then he or she may arrest the accused. However, if the officer searches the suspect and finds something without a warrant then that evidence may use the exclusionary rule. This rule states the following way: The exclusionary rule prevents the government from using most evidence gathered in violation of the United States Constitution.  The exclusionary rule applies to evidence gained from an unreasonable search or seizure in violation of the Fourth Amendment (Cornell University Law School). On the other hand, a probation officer has a totally different way of conducting legal searches. They have to search criminals that are on probation; this means they committed a crime already. Therefore, if the criminal resists or is found carrying contraband they will be sent back to prison. This officer has to have a reason to search the criminal on probation. They need a warrant to search legally. Prison guards I believe have it harder because they must search angry incarcerated criminals from carrying anything into their cells after the court meetings or/and before and after visits form their families and friends because they could’ve sneaked something illegal in jail in to them. An example of conducting interagency collaboration when conducting legal searches would be the following: Imagine a police officer smelled an illegal recreational used substance outside of an individual’s house. The police officer applies the Stop and Frisk law on the individual and takes him in. However, he needs a warrant, to get inside the house and search. This is where a probation officer can get the warrant and search the household of the individual who is in probation. If they find anything, then the individual is taken to court for being accused of carrying drugs, this is where prison officer must them handling the case and take matters into his own hands when frisking the criminal. This is collaboration.

  1. A police officer was conducting an investigation involving an incarcerated prisoner. The police officer would like to know who the prisoner spoke to on the phone and who visited him. Describe who the police officer would need to collaborate with to obtain that information, explaining why.

The police officer must collaborate with the prison guards or the captain/warden of the prison in order to receive that information. This is because the police officer does not have straight access to this information without permission.

  1. Lou, a suspect the officer was investigating in a burglary case, was just convicted for that crime. Prior to his sentence, a pre-sentence report must be conducted. Who is most likely to conduct the investigation: the police officer, probation officer, or the prison guard? Who will he or she collaborate with to complete the report? Support your response by explaining how this process impacts interagency collaboration.

After the accused has been found guilty, the probation officer must schedule an appointment with the criminal and gather information on the following topics: family history, community ties, education background, employment history, physical health, mental and emotional health, history of substance abuse, financial condition, and willingness to accept responsibility for his or her offense (US probation office Southern Office of Indiana.) During the interview and collection of data the probation officer will collaborate with the prosecutor, law enforcement agents, victims, mental health and substance abuse treatment providers, and the defendant’s family members, associates and employer. The officer will also review numerous documents, which may include, court dockets, indictments, plea agreements, trial transcripts, investigative reports from other law enforcement agencies, criminal history records, counseling and substance abuse treatment records, scholastic records, employment records, and financial records (US probation office Southern Office of Indiana.) He/she will do this in order to complete the presentence report.

  1. Select one court case where communication and collaboration were driving factors, and discuss the impact of that case in reshaping the role of the corrections practitioner. This is a critical element D. You will use this same case study when submitting your final project:

  1. Based on your findings regarding the differences in how each branch communicates with each other, which career path is most in line with your communication and collaboration practices and why?

I believe that based on my findings and my research I would say that a probation officers career path is most in line with my communication and collaboration practices. This is because I am studying to become a psychologist and probation officers must carry out a presentence report. I believe carrying out interviews and profiling would be a positive attribute in my resume for a probation officer.
