Capacity: Coursework – Law

Lisa is walking down the street in January when she notices a young man named Denny.  Denny looks a little worse for wear, so Lisa offers to buy him lunch. As they are talking, Denny says to Lisa: “I’m in a pretty rough spot. I don’t have any money right now. But I promise to pay you $450 if you give me that coat you are carrying and some food (that sum represents the reasonable value of those items).  Lisa responds: “How old are you?” Denny states that he is 20. However, this is a lie. Denny is actually 16.  Lisa looks him over one more time, and she agrees to the exchange.

Before they leave, Denny says,”Actually, I will promise to give you another $50 if you let me borrow your bike.”

Lisa writes down all of these promises into a contract. Both parties sign the contract, and they go to the bank and have it notarized.
•A week later Denny trashes the bike, and he tells Lisa that he is not going to pay. Lisa sues Denny in court for breach of contract, and she learns that he is only 16.
•What is likely to happen in the court case?

This M6 Assignment is based on “J.C. Penny’s “Fair & Square” Pricing Strategy” (by E. Ofek and J. Avery, Harvard Business School Cases, 2012, # 9-513-036; in the custom textbook, p. 243-269). You are already familiar with the case and just need to refresh it in your memory. Also, please review Chapter 11 (Peter & Donnelly, 14 ed.).

Your task is to write a learning essay on pricing strategies. You should begin with reading MARKETING INSIGHT 11-2 on retail pricing strategies in your textbook  (p. 197 custom textbook , or p. 175 in the original edition). In your essay please discuss advantages and disadvantages of EDLP and High/Low pricing strategies using the J.C Penny case as an example. It’s a good idea to conduct additional research.

Recommended length: 3-4 pages (plus title page and a list of sources). It is recommended to provide a very brief introduction on pricing strategies. You shouldn’t reiterate the case, the major part of your paper must be devoted to YOUR analysis of advantages and disadvantages of above mentioned pricing strategies.

Unit 8 – Media Analysis Assignment

Purpose/Objective:

To have students use a mass communication theory in their analysis of children’s television programming and to promote media literacy habits.

Instructions:

View 5 to 10 minute clips of children’s programs on TV (you should view at least 3 separate programs). This should range from cartoons to “Sesame Street-type” programs with humans. As you watch the programs pay close attention to the television advertisements that are broadcast on Saturday mornings during the cartoons or during the afternoon hours.

After watching the programs and commercials create a well-developed PowerPoint presentation discussing the follow questions, focused on both the programming and the commercials:

Programming:

What themes, values, stereotypes, and cultural messages did you notice in the children’s programs?
Are there differences and similarities among the programs?
Are these messages part of the mainstreaming process?
Do you think the message of these programs resonate with young viewers?
Commercials:

After viewing the commercials did you see any examples of puffery, hooks, or similar devices in the persuasive messages of the advertisements?

Task:

Create a PowerPoint presentation over this topic.  The presentation should include at least 8-10 slides and should focus on the relationship between your examples and the theories and concepts presented in the textbook.

You should discuss, in detail, your personal responses to the examples you viewed and then use at least 1 theory or concept from the textbook to explain the mass communication problems, issues, or theories associated with the programs you viewed.

Grading:

Your final PowerPoint presentation will be scored based on the following categories:

Quality of information (40 points)  – The material is clear and understandable.  The information discussed is related to main concepts and theories discussed in our textbook.  Supporting details are included and examples are clearly connected to class material.
Organization (20 points) – The information is well organized in a logical way.  The information is easy to understand and focused throughout the entire presentation.
Background and Text (20 points) – The background and text complement each other and slides are free of grammatical and structural errors.
Graphics and Transitions (20 points) – Graphics are appropriate and relate to the content discussed.  Transitions are present and consistent throughout the presentation.

Assessment 1 (Seminar Paper) Twice during the semester, you are required to submit a seminar paper of 1000 words (plus or minus ten per cent). You must use for this assessment task a reliable news media source (print or web-based). If you are not sure, check with me. Seminar papers must reflect critically on appropriate required and recommended readings for the topic you are writing on (provided accurately in a full bibliography). Papers exceeding their word limits will lose 5 complete marks for every 50 words, or part thereof, that they exceed their word limit. Your paper must also be uploaded, as an attachment, to the correct box on Moodle. Papers will not be marked unless they have their originality reports have been generated and they have been uploaded to Moodle. The paper should also demonstrate: a) A fluent and clearly expressed articulation of a contemporary news media issue/event of relevance to IPE; b) An effective engagement with appropriate IPE approaches and perspectives; c) An ability to write fluently, coherently and concisely to show exactly how you are engaging with your chosen event/issue, the readings you have undertaken and IPE theory(ies); d) A capacity to select and deploy sufficient and relevant research, including class readings and independently sourced research, to support your analysis. You must include with each submitted paper: e) A completed Assignment Declaration sheet; f) A full title for your paper, including the source you have chosen to use (this does not count in the overall word count); g) The Moodle Turnitin originality report for your paper (a receipt of submission is not acceptable: each paper must come attached with its actual originality report with the percentage clearly detailed. h) An accurate word count (penalties apply to papers that do not keep to their word limit); i) A complete and accurate bibliography, in the Harvard style, detailing any sources you have used, summarised or cited from, including the news media source you have chosen to use. Footnotes in any form must not be used. Any papers that do not adhere to this requirement will automatically fail. PLEASE READ THIS: Here are some key pointers arising from those discussions. as well as responses to questions I’ve been receiving via email: (1) You need to choose a NEWS MEDIA article, not an academic article. Articles posted on the WTO website by the WTO don’t really count as news media articles – they are information from the WTO directly. Please head to a reputable news media source such as the Wall Street Journal, The Australian, The Guardian, SMH, The Conversation, etc, etc. . Not the news feeds from particular international organisations. (2) I realise that the marking rubric says you have to choose a theory/readings from weeks one to three – I am happy to give you more scope. You can choose from weeks one to seven. I have updated and attached the marking rubric with this information. FYI the rubric has also been on the website, as mentioned, since the start of semester. You need to go to the link ‘all about the course’ then to the ‘assessment’ tab and scroll right down to the bottom for the rubrics. (3) You need to submit the assignment both via turnitin AND in hard copy by 4pm on Friday May 1. Late work will attract the late penalties outlined in the course guide. (4) in relation to the news article we discussed in class – we focussed on four main rubric criteria: (a) With which big IPE / GPE (Global Political Economy) debates does this article engage (that we’ve discussed in class)? We talked about how this article related to debates regarding the impact of increasing economic integration (‘globalisation’) on state’s policy room to move (and sovereignty more broadly), we also talked about debates re trade agreements potentially ‘kicking away the ladder’ for countries, we also talked about debates about the shift from multilateralism to preferentialism and the possible risks / rewards of this… We also talked about the theoretical debates that this might relate to, such as debates between liberals and economic nationalists about the desirability of strategic industrial policy. We made the point that you don’t need to focus on EVERY debate that the article relates to – the point is for you to convince the marker that you can see how this article is very relevant to a particular IPE/GPE debate – you only have 1000 words after all. (b) Which theories that we’ve analysed are relevant and useful lenses through which to engage with the article? We identified 3 – neoliberalism and economic nationalism (for reasons noted above) as well as institutionalism – especially the end of the article which talks about the fact that although they are facing very similar external constraints (in the shape of trade agreements) Korean and Australian policy makers are responding very differently – an institutionalist approach (which emphasises the mindset / worldview of policymakers) and path dependency ideas might help to explain such differences (c) Which COMPULSORY readings are relevant and shed light on the issues in the article We identified a number – the Ha-Joon Chang article on kicking away the ladder, the Bell reading on institutionalism, and the Weiss reading on globalisation and domestic institutions (d) Which WIDER ACADEMIC READINGS should you draw on? We noted that you can start with the recommended reading list here – and go beyond if you would like to – but the wider readings should include ACADEMIC articles, not news articles. example of news media article: http://theconversation.com/australias-procurement-policy-leaves-our-exporters-behind-32569

Attitudes and Dealing

I must have at least 7 References. Paper must have a Reference Page. I will provide all of the documents for the References.  For this essay I need it written around answering ALL of the following questions.

1. Compare and contrast the Muslims’ and Christian Europeans’ attitudes towards and dealings with the indigenous peoples of Africa, Asia, and the Americas.

2. Elite Christian Europeans often despised and, from a modern perspective, horribly mistreated members of their own civilization and especially those of other ones. All the while, there were  ‘optimists’ who believed that Europeans could improve and better the(ir) world through education, exploration, and conversion, such as Peter Abelard, Pico Della Mirandola, Castiglione, and even Christopher Columbus.  There were also reformers and revolutionaries, like the nobles of England during John II’s reign (Magna Carta), John Ball, Erasmus, Luther, Bartolome de Las Casas, and Pope Paul III, who sounded shrill calls of protest and self-criticism, demanding that authorities reform institutions and beliefs in order to end rampant abuses. How significant were the efforts of the ‘optimists’ and ‘reformers’ (in fact or as precedent) when balanced against Europeans’ record of black deeds?
