Victimization of Special Populations

This week’s required readings explains how a person can become a victim of violence because their age or ability level makes them vulnerable. Becoming a crime victim is traumatic for every victim; however, depending on one’s situation in life, victimization can have compounded challenges. Specifically, special populations of victims have unique risk factors for victimization, extent of victimization, and different responses are used to address the victimization. Please discuss the victimization of persons with disabilities, persons with mental illness, and incarcerated persons.

Address the following in your initial post:

  • Explain how characteristics of these victims can contribute to their victimization.
  • Evaluate the criminal justice system’s response to the victimization of this population of victims.
  • Propose a holistic plan for providing restitution for this population of victims.

Unit 5: Scenario; Criminal Justice

Unit 5: Scenario; Criminal Justice

Scenario

A member of your family was brutally murdered. The inmate is currently on death row, awaiting execution. A member of a victims’ rights group contacts your family to discuss the possibility of meeting with your family and the convicted murderer. The inmate wants to seek forgiveness before he is executed. The members of your family are outraged that this group dared to even contact your family. Members of your family express their concern regarding the invasion of their privacy. No matter what the inmate will say, it will not bring the family member back, and your family is not concerned with the inmate’s feelings or his desire to make amends for the crime he committed. Most your family members are opposed to meeting the convicted murderer, but you have some unanswered questions, and this would help you deal with the death of your loved one.

You are going to have a family meeting on this matter to decide what action your family should take. You are preparing some information and performing research on whether or not meeting the convicted murderer would benefit your family and bring closure to this tragedy. In your discussion, include theories of morality, values, and consequences. You must also include the following information for the family to ensure that everyone is fully informed:

  • In terms of ethics, describe the concepts and purposes of restorative justice and restitution.
  • Address some ethical issues related to the concepts of restorative justice and restitution.
  • Include some implications of restorative justice and how you would approach the decision to allow or refuse a meeting with a convicted murderer.
  • Compose a description of the ethical decision-making process, including the steps on how to approach the situations, a list of questions if a meeting is granted, or a list of possible reasons for rejecting the meeting.

Three Branches of the Criminal Justice System

As explained, the criminal justice system is separated into three branches: law enforcement, courts, and corrections. What is each branch responsible for? How do they interact with one another? Explain how each of these pieces of the system work to complement the others. What would happen if one branch of the system were broken? Describe how the malfunction of one criminal justice system branch would affect the operation of the other two branches.

Research and Analysis Paper; Response to the Attacks of 9/11

Research and Analysis Paper; Response to the Attacks of 9/11

The events of 9/11 devastated our Nation’s sense of security and changed the outlook of law enforcement forever. Aside from the impact the attacks had on this Nation; be it the death toll, the economic impact, etc., law enforcement faced other unknown challenges on that fateful day. Several law enforcement and private sector agencies ranging from the New York City Police Department to FEMA arrived at Ground Zero only to find that their ability to communicate was severely inhibited due to incompatible equipment and fragmented technologies.

For this assessment, please research the communication challenges law enforcement agencies may have faced, be it internal, or in relation to other agencies, when responding to a particular disaster, either natural or man-made. Write a 3−5 page paper that:

1.Details the facts of the incident and the specific communication problems encountered

2.The consequences of those problems in terms of lives lost, etc.

3.The steps taken by the relevant agencies to address those problems. If no steps were taken, what steps should be taken?

A Proposal for a new crime prevention program

Criminal Justice

A Proposal for a new crime prevention program

You will create a proposal for a new crime prevention program that targets juveniles and determine how you will evaluate its effectiveness. You may use elements of the three crime prevention programs you researched for your Unit 8 Assignment or come up with completely different components.

In the analysis of how your program will deter juvenile delinquency, you will want to use data from your three comparison programs to support your new program. For example, how many juveniles are enrolled in the program? In order to deliver the best programming possible for juveniles in the K–12 school system, calculate the optimal ratio of staff to the target population, based on the average ratio of the comparison programs.

Your analysis should specifically identify the data source and include a summary of the data.

In addition, you will want to specifically address how the data were used to inform your thinking on the development of your new program (i.e., how you used the data to solve a real-world problem).

Create a 13- to 15-slide PowerPoint presentation incorporating speaker notes to include the following:

•Who is your target population, what are your goals, and how will your program be implemented?
•Explain your program, detailing the elements of it and why it will be effective.
•Describe how the program’s effectiveness will be analyzed and how the objectives will be evaluated.
•Specify how deterrence will be measured and what will be considered effective deterrence.
Include a reference and title slide.

Cite a minimum of three sources in your reference slide, using in-text citations in the presentation where appropriate.

For the final assessment, you will create a career path investigation in which you answer questions related to each of the branches. You may complete your project as either a Word document or as a presentation. Your investigation will be 4–5 pages or approximately 10–15 slides. From your investigation into each of the branches, you will be able to reflect on and determine a potential career path within the criminal justice field.
If you choose to follow a presentation format, these are some recommended programs: PowerPoint, Prezi, Pixxa Perspective, or Haiku Deck. In your presentation, be sure to utilize the speaker notes section of each slide for the bulk of the content. The speaker’s notes are to be used to explain why you put the information on the slide, and you will be assessed heavily on this information. The speaker notes are the words you would say if you were presenting the slides to an audience. The tone of these notes should be professional. View this document for additional details on guidelines for presentations.
You will now be investigating three major areas involving the three branches of criminal justice. Before you proceed, consider your career aspirations in criminal justice and where you might possibly see yourself upon completion of your degree. After each section, you will be given the chance to reflect upon your decision based on your findings.

Communication and Collaboration

Adriana Gonzalez

  1. How does the ability to conduct legal searches differ between the police officer, probation officer, and prison guard in the performance of their duties? Give an example of interagency collaboration when conducting a legal search.

In order for the criminal justice system to work it has to be organized. Everyone must collaborate and be on the same page. Even though different officers have different titles, they must all agree on certain terms. Legal searches for a police officer works quite differently than that of a prison guard or a probation officer. In order for any legal searches to be executed, the police must obey the law of the stop and frisk. This law is present in a situation in which the police officer that is suspicious of an individual detains this person and searches with his hands in the suspect’s body for a weapon or illegalities. If the cop finds something illegal then he or she may arrest the accused. However, if the officer searches the suspect and finds something without a warrant then that evidence may use the exclusionary rule. This rule states the following way: The exclusionary rule prevents the government from using most evidence gathered in violation of the United States Constitution.  The exclusionary rule applies to evidence gained from an unreasonable search or seizure in violation of the Fourth Amendment (Cornell University Law School). On the other hand, a probation officer has a totally different way of conducting legal searches. They have to search criminals that are on probation; this means they committed a crime already. Therefore, if the criminal resists or is found carrying contraband they will be sent back to prison. This officer has to have a reason to search the criminal on probation. They need a warrant to search legally. Prison guards I believe have it harder because they must search angry incarcerated criminals from carrying anything into their cells after the court meetings or/and before and after visits form their families and friends because they could’ve sneaked something illegal in jail in to them. An example of conducting interagency collaboration when conducting legal searches would be the following: Imagine a police officer smelled an illegal recreational used substance outside of an individual’s house. The police officer applies the Stop and Frisk law on the individual and takes him in. However, he needs a warrant, to get inside the house and search. This is where a probation officer can get the warrant and search the household of the individual who is in probation. If they find anything, then the individual is taken to court for being accused of carrying drugs, this is where prison officer must them handling the case and take matters into his own hands when frisking the criminal. This is collaboration.

  1. A police officer was conducting an investigation involving an incarcerated prisoner. The police officer would like to know who the prisoner spoke to on the phone and who visited him. Describe who the police officer would need to collaborate with to obtain that information, explaining why.

The police officer must collaborate with the prison guards or the captain/warden of the prison in order to receive that information. This is because the police officer does not have straight access to this information without permission.

  1. Lou, a suspect the officer was investigating in a burglary case, was just convicted for that crime. Prior to his sentence, a pre-sentence report must be conducted. Who is most likely to conduct the investigation: the police officer, probation officer, or the prison guard? Who will he or she collaborate with to complete the report? Support your response by explaining how this process impacts interagency collaboration.

After the accused has been found guilty, the probation officer must schedule an appointment with the criminal and gather information on the following topics: family history, community ties, education background, employment history, physical health, mental and emotional health, history of substance abuse, financial condition, and willingness to accept responsibility for his or her offense (US probation office Southern Office of Indiana.) During the interview and collection of data the probation officer will collaborate with the prosecutor, law enforcement agents, victims, mental health and substance abuse treatment providers, and the defendant’s family members, associates and employer. The officer will also review numerous documents, which may include, court dockets, indictments, plea agreements, trial transcripts, investigative reports from other law enforcement agencies, criminal history records, counseling and substance abuse treatment records, scholastic records, employment records, and financial records (US probation office Southern Office of Indiana.) He/she will do this in order to complete the presentence report.

  1. Select one court case where communication and collaboration were driving factors, and discuss the impact of that case in reshaping the role of the corrections practitioner. This is a critical element D. You will use this same case study when submitting your final project:

 Estelle v. Gamble, 429 U.S. 97 (1976)https://www.law.uh.edu/healthlaw/perspectives/2009/(CC)%20Prison%20Health.pdf

On this case the corrections practitioner’s role was reshaped because the criminal became switched the roles by filing a lawsuit. Gamble got injured during prison’s manual labor, and he wanted better attention medically. This was ironic because the criminal is filing a lawsuit against the corrections.

  1. Based on your findings regarding the differences in how each branch communicates with each other, which career path is most in line with your communication and collaboration practices and why?

I believe that based on my findings and my research I would say that a probation officers career path is most in line with my communication and collaboration practices. This is because I am studying to become a psychologist and probation officers must carry out a presentence report. I believe carrying out interviews and profiling would be a positive attribute in my resume for a probation officer.
